Marcaj

Terms of Service

Effective October 15, 2026

These terms govern your use of Marcaj. In short: keep your account secure, upload only data you have the right to share, keep the tasks you work on confidential, and keep your own copies of anything important — the service is provided as is.

1. Who we are and what these terms cover

Marcaj is an online platform for preparing training data: customers create labeling projects and upload data, and annotators and validators label and review it. The platform is operated by „MARCAJ” S.R.L., str. Grădina Botanică 14, bl. 3, of. 307, MD-2032, sect. Botanica, mun. Chișinău, Republica Moldova, IDNO 1026023147217 ("we", "us").

These Terms of Service ("Terms") form an agreement between you and us and apply whenever you access or use Marcaj. The Privacy Policy and the Cookie Policy form part of them. If you use Marcaj on behalf of a company or another organization, you confirm that you are authorized to accept these Terms on its behalf.

If your organization has signed a separate written agreement with us, that agreement prevails over these Terms where the two conflict.

2. Your account

You must be at least 16 years old to create an account. You agree to give accurate registration details and keep them up to date.

  • Keep your password secret and do not share your account. You are responsible for activity carried out through it.
  • Tell us promptly at emirza@marcaj.com if you suspect unauthorized access.
  • If you sign in with Google, Google's terms also apply to that sign-in.

You can delete your account at any time from Settings. Deletion is described in the Privacy Policy.

3. Organizations, roles and projects

Work on the platform happens inside organizations. An organization's administrators invite members, assign each of them one role (annotator, validator, manager or administrator), group them into teams and decide which projects each team may access.

The organization is responsible for how it configures access and for the instructions it gives its members. Marcaj provides the tools; it does not decide who works on which data.

4. Your content

"Content" means everything you or your organization put into Marcaj: images, point clouds and other files, label sets, annotator guides, annotations, review remarks and comments.

  • You keep ownership. As between you and us, the customer that owns a project owns its data and the annotations produced in it, including annotations made by other members of the organization.
  • Licence to us. You grant us a non-exclusive, worldwide, royalty-free licence to host, copy, process, display and transmit Content only as needed to run Marcaj for you and the people you share it with. We do not use your Content to train our own models or sell it to anyone.
  • Your responsibility. You confirm that you have the rights, permissions and — where Content contains personal data, such as faces or licence plates — a lawful basis to upload it and have it labeled. For such personal data, the organization acts as controller and we act as its processor.

5. Working on tasks

If you label or review data, you agree to:

  • keep the data, instructions and results of the projects you access confidential, and not copy, download or share them outside the platform except through the platform's own export features available to your role;
  • follow the project's annotator guide and do the work yourself;
  • not attempt to identify individuals shown in the data or use it for any purpose other than the task.

Marcaj records the time you actively spend on tasks and the outcome of reviews. That information is visible to the organization's managers, as explained in the Privacy Policy.

Any payment or employment arrangement between an annotator and a customer is a matter between them. Marcaj does not currently process payments and is not a party to such arrangements.

6. Acceptable use

You must not use the platform to:

  • upload unlawful content, including child sexual abuse material, content that infringes someone else's rights, or personal data you have no lawful basis to process;
  • upload malware or attempt to probe, scan or test the vulnerability of the platform without our written permission;
  • access accounts, organizations or projects you have not been given access to, or circumvent rate limits or other technical restrictions;
  • overload the service, scrape it, or reverse-engineer it, except to the extent the law allows despite this restriction;
  • harass other users or misuse review comments and mentions;
  • resell or provide the service to third parties without our agreement.

We may remove content or suspend access that breaches this section, as described in section 10.

7. Our intellectual property

The platform — its software, design and documentation, and the Marcaj name and logo — belongs to us or our licensors. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable right to use it for its intended purpose. If you send us feedback, we may use it without obligation to you.

8. Availability and changes to the service

We are continuously developing Marcaj. Features may be added, changed or removed, and the service may be interrupted for maintenance or because of events outside our control. We do not guarantee any particular level of availability unless a separate written agreement says so.

Keep your own copies. The platform is not a backup service. Export anything you need to keep regularly using the export formats provided.

Third-party services we rely on (such as hosting and email delivery) are listed in the Privacy Policy.

9. Disclaimer and limitation of liability

Marcaj is provided "as is" and "as available". To the extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and that annotations produced on the platform will be accurate or complete.

To the extent permitted by law, we are not liable for indirect or consequential loss, loss of profit, revenue or data, and our total liability arising out of these Terms in any twelve-month period is limited to the amount you paid us for the service in that period, or EUR 100 if you paid nothing.

Nothing in these Terms limits liability for death or personal injury caused by negligence, for fraud, for intentional misconduct or gross negligence, or any other liability that cannot be limited by law. If you are a consumer, you also keep the rights mandatory consumer law gives you.

10. Suspension and termination

You may stop using the platform and delete your account at any time.

We may suspend or close an account, or remove content, if you materially breach these Terms, if required by law, or to protect the platform or other users. Where reasonable we will tell you in advance and give you a chance to fix the problem and export your data.

Sections that by their nature should survive termination — including 4, 7, 9 and 12 — continue to apply.

11. Changes to these Terms

We may update these Terms. The date at the top shows when the current version took effect. For material changes we will notify you in the app or by email at least 30 days in advance; if you keep using the platform after that, the new version applies. If you do not agree, you can delete your account before it takes effect.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Moldova, and the courts of the Republic of Moldova have jurisdiction, without depriving consumers of the protection of the mandatory law and courts of the country where they live.

If any provision of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it.
